Delegation of Authority - Natural Resource Damage Assessment and Restoration Trustee Representation
The attached delegation of authority was signed by Commissioner John Boyle, and is posted here pursuant to AS 44.62.175(a)(6):
Pursuant to authority delegated to the Department of Natural Resources (DNR) Commissioner by Governor Tony Knowles in 1999 under 42 USCS §9607(f)(2)(B) and 33 USCS § 2706(b)(3), I hereby delegate my authority to the Director of the Division of Mining, Land and Water to act as the DNR Trustee in Natural Resource Damage Assessment and Restoration (NRDAR) activities undertaken pursuant to the Oil Pollution Act; the Comprehensive Environmental Response, Compensation, and Liability Act; and the Federal Water Pollution Act. Delegated NRDAR Trustee actions may include, but are not limited to, approving the release of case documents to the public record, signing Memorandums of Agreement with co-trustees to participate in NRDAR processes, and signing settlement agreements in the amount of $250,000 or less. This delegated authority may be redelegated, as needed.
