Washington, D.C. - In response to the invalidation of the Biden Administration's overtime rule by the U.S. District Court for the Eastern District of Texas, Small Business & Entrepreneurship Council (SBE Council) president & CEO Karen Kerrigan issued the following statement:
"We are pleased with the court's ruling. Federal government agencies must follow the rules and procedures when making new rules and stay within the statutory authority granted by Congress. In the case of the overtime rule, Labor Department officials clearly exceeded their authority."
"The relief provided by the invalidation of the onerous overtime requirements will help struggling small business owners. It will allow employers to align their compensation approach with the needs and flexibility of the individual worker and marketplace. Small business owners and their workers are both better served by the court's ruling."
"President Biden's Labor Department created unnecessary costs and uncertainty for small businesses by pushing through this politically-motivated rulemaking. Unfortunately, this has been a pattern on multiple rulemakings and regulatory proceedings, and across federal agencies. If regulators would merely follow the law and procedures when creating or expanding regulations, and listen to the concerns and feedback of small business owners during that process, the U.S. economy and conditions would be much more stable and supportive of small business owners and their dedicated employees."
