Attorney General Marshall Announces Court of Criminal Appeals Upholds Capital Murder and Attempted Murder Convictions in Jefferson County

(Montgomery, Ala.) - Attorney General Steve Marshall announced that the Alabama Court of Criminal Appeals affirmed the convictions of Alfreda Janapril Fluker, 44, of Birmingham, for capital murder and attempted murder. Fluker was convicted in the Jefferson County Circuit Court on February 6, 2023.

The evidence at trial showed that on the night of April 10, 2020, Fluker, a Birmingham police officer, followed her boyfriend, also a Birmingham police officer, to a local park. While there, she observed her boyfriend with another woman inside his vehicle. Fluker approached the vehicle and began firing a gun and the resulting gunshots killed the female passenger in the vehicle. Fluker did not dispute that she killed the victim at trial but instead argued that her actions did not constitute capital murder but instead constituted a lesser offense.

Jefferson County District Attorney Danny Carr's office successfully prosecuted the case and obtained the guilty verdicts. Fluker was sentenced to forty years imprisonment for her convictions. Fluker sought to have her convictions reversed on appeal.

The Attorney General's Criminal Appeals Division handled the case during the appeals process, arguing for the Alabama Court of Criminal Appeals to affirm Fluker's convictions. The Court did so in a decision issued Friday, November 8, 2024.

Attorney General Marshall commended Assistant Attorney General John J. Davis for his successful work on this case and thanks District Attorney Danny Carr and his staff, for their valuable assistance in defending the capital murder and attempted murder convictions.
