APA Announces Public Comment Period for Proposed General Permit Revocations

RAY BROOK, NY -The Adirondack Park Agency (APA) is accepting public comment on a proposal to revoke the following general permits:

- GP2005G-2R for Minor Projects Not In Or Impacting Wetlands;

- GP2005G-5R for Subdivisions to Convey Two or More Lots Without Principal Building Rights;

- GP2010G-3 for Change in Use of an Existing Commercial, Public/Semi-Public, or Industrial Building;

- GP2011G-1 for Subdivisions Involving Wetlands; and

- GP2011G-2 for New York State Department of Transportation Herbicide Vegetation Management for Guide Rail and Sign Delineator Posts Adjacent to Wetlands in the Adirondack Park.

The five general permits in question were created for project sponsors to receive expedited permits for certain regulated proposals. However, these general permits cause confusion among project sponsors as to what information is required for a complete application. This creates inconsistencies with regard to project review, the level of detail requested for project plans, and what conditions are ultimately used in the final permit. The specific proposals eligible for the above general permits can all be reviewed using existing applications, or in some instances, qualify as non-jurisdictional activities to the Agency.

The APA will accept public comment on proposed General Permit 2024G-1 until October 31, 2024.

The Adirondack Park Agency proposes to revoke General Permits GP2005G-2R Minor Projects Not In Or Impacting Wetlands, GP2005G-5R Subdivision to Convey Two or More Lots Without Principal Building Rights, GP2010G-3 Change in Use of an Existing Commercial, Public/Semi-Public, or Industrial Building, GP2011G-1 Subdivisions Involving Wetlands, and GP2011G-2 New York State Department of Transportation Herbicide Vegetation Management for Guide Rail and Sign Delineator Posts Adjacent to Wetlands in the Adirondack Park. As a result, these five General Permits will:

1. No longer be effective from the date of revocation by the Agency;

2. Not be used to authorize jurisdictional activities pursuant to Article 24 of the Environmental Conservation Law (the Freshwater Wetlands Act), Executive Law §§ 809(2)(a) and 810(1), and Agency Rules and Regulations at 9 NYCRR § 578.2(a);

3. No longer be issued for certain regulated activities;

4. Not result in a significant adverse environmental impact as no change to the Agency's jurisdiction or review process is being made. Agency review of permit applications will remain unchanged; and

5. Not require a procedure for issuance given the inherent nature of the revocation of these general permits.

Revoking these five general permits will streamline the permit process for both applicants and Agency staff.
